Terms of Service

1. Service Description

Plug N Play ("the Service," "we," "us," or "our") is a cloud-based, multi-tenant enterprise resource planning (ERP) platform designed for service businesses. The platform provides customer relationship management (CRM), scheduling, invoicing, training program management, client portals, team management, reporting, and over 100 additional modules accessible through a web browser or mobile application.

By creating an account or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information when creating your account and keep it updated.
• Use a strong, unique password and enable multi-factor authentication when available.
• Notify us immediately at legal@plugnplay.app if you suspect unauthorized access to your account.
• Ensure that any team members or staff you add to your account comply with these Terms.

Each business account may have one owner and multiple team members. The account owner is responsible for managing access and permissions for all team members.

3. Acceptable Use

You agree to use the Service only for lawful business purposes. You may not:

• Use the Service to store, transmit, or distribute content that is illegal, harmful, threatening, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission.
• Resell, sublicense, or redistribute the Service to third parties without a written reseller agreement.
• Upload files containing viruses, malware, or any other code designed to disrupt or damage the Service.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, depending on the severity of the violation.

4. Payment Terms

Plug N Play offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Paid plans are billed on a monthly or annual basis, as selected during checkout. Annual plans are billed upfront for the full year.
• All fees are quoted in US dollars and are non-refundable unless otherwise stated or required by law.
• We use Stripe to process payments. Your payment information is handled directly by Stripe and is subject to Stripe's Privacy Policy.
• If a payment fails, we will notify you and attempt to charge the payment method on file up to three times over seven days. If payment is not received, your account may be downgraded to the free tier or suspended.
• We may change our pricing with at least 30 days' notice. Price changes apply at the start of your next billing cycle.

5. Free Trial

We offer a 14-day free trial of our paid features for new accounts. During the trial period:

• You have access to all features available in the Professional plan, with no restrictions.
• No credit card is required to start a free trial.
• At the end of the 14-day period, your account will automatically revert to the free tier unless you subscribe to a paid plan.
• Data you create during the trial is preserved when you subscribe. If you do not subscribe, your data remains available in read-only mode for 30 days, after which it may be deleted.

6. Intellectual Property

The Plug N Play platform, including its design, code, features, documentation, logos, and trademarks, is the intellectual property of Plug N Play and is protected by copyright, trademark, and other intellectual property laws.

You retain full ownership of all data, content, and materials you upload to or create within the platform ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to host, store, and process Your Content solely for the purpose of providing the Service to you.

We do not use Your Content for any purpose other than delivering the Service. We do not train machine learning models on Your Content and do not share it with third parties except as described in our Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Plug N Play and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Service Availability and Uptime

We strive to maintain 99.9% uptime for the Service. Scheduled maintenance windows are announced at least 48 hours in advance and are typically conducted during off-peak hours (between 2:00 AM and 5:00 AM Eastern Time). We are not liable for downtime caused by circumstances beyond our reasonable control, including internet outages, third-party service failures, or force majeure events.

9. Termination

You may cancel your account at any time from within the platform settings. Upon cancellation:

• Your subscription will remain active until the end of your current billing period.
• After your subscription ends, your account will revert to the free tier.
• You may export your data before cancellation. After 30 days on the free tier with no activity, we may delete your data.

We may terminate or suspend your account immediately if you violate these Terms. In cases of suspected fraud, illegal activity, or severe terms violations, termination may occur without prior notice.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, United States of America, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in the State of New Jersey.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
